Glossary · Testing and assessment

Hiring a vDPO buys privacy expertise; whether it fills a legal post depends on the law.

An external privacy specialist engaged on contract to run or guide a company's data protection work, and sometimes to act as its data protection officer where the law allows.

01 · In plain words

In plain words

An external privacy specialist engaged on contract to run or guide a company's data protection work, and sometimes to act as its data protection officer where the law allows.

A vDPO is a service, not a legal title. The provider tracks your processing, answers privacy questions, handles data principal or data subject requests, and advises on new products. Whether they can also be your formal data protection officer depends on which law applies and what it says.

Spelled out: Virtual Data Protection Officer.

02 · Why it matters

Why it matters

Who cares about this, and what depends on it.

Under the EU's GDPR, an organisation that must appoint a DPO may use a staff member or someone under a service contract, so an outsourced DPO is a recognised model. India's DPDP Act is different. It requires a significant data fiduciary to appoint a DPO who represents it, is based in India and answers to its board or similar body. Whether an external contractor can hold that post is not settled by the Act's text alone. Other data fiduciaries must publish contact details for a DPO if they have one, or for a person who can answer questions about their processing, and a vDPO can often fill that contact role.

03 · Where you meet it

Where you will meet it

The documents, meetings and reports where it appears.

Privacy notice
The contact point for questions and requests about personal data.
DPDP Act, section 10
The extra duties of a significant data fiduciary, including the DPO appointment.
GDPR Articles 37 to 39
When a DPO is mandatory, who may serve, and the independence the role needs.
Processor contracts and client reviews
Customers ask who leads privacy and how requests are handled.

04 · An example

A worked example

An illustration, not a real client.

Illustrative: a direct-to-consumer skincare brand

An online skincare brand in India holds order histories, skin-type quiz answers and marketing preferences for many customers. It is not a significant data fiduciary. It engages a vDPO who builds a data map, rewrites its consent notices, sets up a request inbox with response steps, and is named in the privacy notice as the contact for questions. The brand's founders remain the decision makers; the vDPO advises and runs the process.

05 · Easy to mix up

Easy to mix up with

Neighbouring terms that mean something different.

DPO (statutory)
A role a law requires in defined cases, with set conditions. A vDPO is a contract service that may or may not meet them.
Grievance officer
A contact for complaints under Indian rules. A vDPO may handle that inbox, but the titles and duties differ.
Privacy counsel
Gives legal advice on how a law applies. A vDPO runs the programme day to day and refers legal questions to counsel.

06 · What to do

What to do with it

Practical steps, and the guides that go deeper.

  • Decide first whether a law requires you to appoint a DPO, and under which conditions.
  • If you are a significant data fiduciary, have counsel confirm whether an external appointee can meet the Act's conditions.
  • Define what the vDPO decides, what they advise on, and how they reach your board.
  • Name the contact point in your privacy notice and test that requests reach it.

Questions about vDPO

Can a vDPO be our DPO under the DPDP Act?

Unclear for significant data fiduciaries; ask counsel.

The Act sets conditions for a significant data fiduciary's DPO: an individual based in India who represents the fiduciary and is responsible to its board or similar body. Whether a contractor can meet those conditions depends on how the appointment is structured. Counsel should confirm how the law applies to your contracts.

Does the GDPR allow an outsourced DPO?

Yes, on a service contract.

The GDPR lets the DPO be an employee or someone working under a service contract, provided they have the expertise, independence and resources the role needs and no conflicting duties.
